SENATE CONCURRENT RESOLUTION NO. 78

Requesting the Joint Committee on Government and Finance study the legal feasibility of the Division of Highways providing private cemetery road maintenance.

Whereas, Citizens of West Virginia have a long-standing tradition of creating family cemeteries to both bury and honor deceased members of their family; and
Whereas, Many family cemeteries may only be accessed by using private roads which are often in need of emergency repairs; and
Whereas, These private roads are located outside the jurisdiction of the Division of Highways; therefore, be it
Resolved by the Legislature of West Virginia:
That the Joint Committee on Government and Finance is hereby requested to study the legal feasibility of the Division of Highways providing private cemetery road maintenance; and, be it
Further Resolved, That the Joint Committee on Government and Finance review and recommend possible funding sources to offset the costs of private cemetery road maintenance borne by the Division of Highways; and, be it
Further Resolved, That the Joint Committee on Government and Finance report to the regular session of the Legislature, 2007, on its findings, conclusions and recommendations, together with drafts of any legislation necessary to effectuate its recommendations; and, be it
Further Resolved, That the expenses necessary to conduct this study, to prepare a report and to draft necessary legislation be paid from legislative appropriations to the Joint Committee on Government and Finance.
